Inktober Book Plagerism Accusations
-
@glenfx I interpreted his keeping things “under wraps” as him keeping it private. I think in a social media world, fans feel like creators and artists have an obligation to tell them everything; that’s not the case. It’s for lawyers to decide privately and it makes sense that the public wasn’t told everything. Personally I wouldn’t want every piece of my business aired out for the entire world to see.

@glenfx i think the reaction would still be the same had Jake announced it or not. ️ there’s really no safe way to go about it

This wasn't supposed to be the focus and merely a note but,
@lpetiti In this case when he created Inktober he encourage everyone to use the hashtag and even said people could use the logo (I joined it since the start), so after years of people promoting it as a community he registered the trademark without telling anyone until two years later when people found out by receiving cease and desist emails by lawyers and just after that he said it was due to concerns and because he wanted to do a book using inktober as the title.
If he had told to the community about it, something like "hey guys since I've seen companies selling stuff with my inktober logo without permission and before someone with ill intentions take it as theirs and maybe harming the community, since I created it I took a step and I'm in the process of trademarking it, unfortunately this might make some changes but we'll figure something out together".
Instead of two years later be like, ooops I forgot to tell you guys but you can't use the inktober title and logo in your books alone but hey keep using it and promoting it, I'm sorry you knew about it due to those who received a C&D letter, I will give some sort of special pass to use the title while I'm still not telling you I trademarked it a couple of years ago until someone looks for it.I think more people would stand by his side if he had done something like this.

@glenfx He registered the trademark to make the book and merch, he never intended to go after the artists participating so he clearly never considered it would become an issue. He probably thought it wasn't important to make a public announcement. It's easy to judge from the outside after the fact but hindsight is 20-20, isn't it? I've made plenty of business mistakes too, it happens to all of us.
-
@NessIllustration I agree. I think it’s important to remember that these massive public figures are not omniscient.
-
@NessIllustration He is a seasoned professional, not a starting out artist, he has done many books and co-created SVSL before (which should have been registered in some form) and should have known that, In my country of origin the laws are useless and yet I know what copyrights and trademarks are about in the US, why wouldn't he?.
Trademarks are a huge bigger deal and much more serious than just copyrights registration and I don't think he did it without using a lawyer (which he did say was the one who sent the C&D) or basic knowledge, it takes a long time to do and cost money, so "not knowing" about it is not a credible excuse.
Unfortunately he did screw up, he might have thought it wouldn't happen, but he knew it could or would at some point. And again, I only mentioned it as a note that even though I'm not a fan of him like I used to be because of that, I DO look forward to his book regardless of what he did.
It is kind of pointless to turn this into a debate here.Oh btw, In amazon (europe) there seems to be a pre-order for the book, it also states March 19, would be great to know if that info is correct though.
-
@glenfx Okay Of course there was a screw up, no one's denying that. I'm just not a big fan of passing high and mighty judgement and never letting it go, especially when it obviously wasn't intended and the person has taken steps to fix it. If holding grudges is your thing, go for it mate. Don't really want to debate this either.
-
@NessIllustration If I held a grudge I wouldn't have defended him over Alphonso's book and all the people adding to the hate, nor would I be looking for the book, it seems like you guys only read my first line and went defensive mode.
But that doesn't mean I must like him just because, if you can't handle that and want to make it a bigger deal than it is its not my problem. -
@glenfx It's really not about liking him or not - this is just ancient history that's been solved years ago. I don't know why keep bringing that up over and over again, especially when it has little to do with the topic at hand (the Inktober all year long book).

@NessIllustration right now you are the one keep digging. agree to disagree and move on. this thread is about the book case so keep it at it. thats enough drama, no need for more. he made his point, you too...do some art
